New Jersey Quietly Issues "Withholding of Care" Rules to justify Killing Patients

“Patients showing substantial clinical deterioration that portends a very low chance for survival will have critical care discontinued.”   Such is a new "rule" quietly issued OVER THE WEEKEND by the New Jersey Department of Health concerning who gets care when the healthcare system is stressed . . .  as it is now.

State officials have issued new emergency triage guidelines on the use of scarce hospital resources for critically ill patients, should the public health emergency over the coronavirus worsen.

The rules would mean that patients would be prioritized over whether they receive resources in scarce supply, most specifically ventilators.

Health Commissioner Judith Persichilli said the triage plan would be used to help determine whether the ongoing provision of critical care resources were justified for individual patients and would only occur in a worse-case scenario.

“These triage guidelines are intended to be the last resort. We hope and have planned that they will not be needed,” she said.

The rules over withholding of care would only kick in if a hospital is operating under a crisis standard of care, if a public health emergency is declared, and if critical care capacity is or will be shortly overwhelmed — despite taking all appropriate steps to increase the surge capacity to care for critically ill patients, according to Persichilli.

According to the guidelines that were issued over the weekend, triage teams for each hospital would use priority scores based on such issues as a patients’ likelihood of surviving to hospital discharge and the presence of a severely limited life expectancy — even if the patient survived the acute critical illness.

The triage guidance said “patients who are more likely to survive with intensive/critical care are prioritized over patients who are less likely to survive with intensive care/critical care. Patients who do not have a severely limited life expectancy are given priority over those who have such advanced conditions that they have a very limited life expectancy even if they survive the acute critical illness.”

The guidelines said all patients will be eligible to receive critical care beds and services regardless of their priority score, “but available critical care resources will be allocated according to priority score, such that the availability of these services will determine how many patients will receive critical care. Patients who are triaged to not receive ICU/critical care beds or services will be offered medical care including intensive symptom management and psychosocial support.”

Patients would also be reassessed through the emergency.

“Patients showing improvement will continue to receive ICU/critical care services until the next assessment,” the guidelines stated. “Patients showing substantial clinical deterioration that portends a very low chance for survival will have critical care discontinued.”

The rules talk at length about the "ethics" of depriving a person of life-sustaining health care, but nowhere do they talk about the Constitutional issues.

No person can be deprived of life, liberty or property without due process of law.  The State Department of Health, by promulgating these rules, is literally forcing hospitals to act as agents of the state; and that immediately implicates the Constitution.

The New Jersey Department of Health cannot deprive any person of their liberty - in this case to purchase life-saving health care - without due process of law.  Yet this new "rule" will do exactly that. Moreover, it will do so at a time when a person is least able to seek legal remedy to assure their rights.  In the time it takes to attempt a legal remedy, the withholding of care is quite likely to result in the death of the person involved, making their legal efforts moot.

    We have Family working in the hospitals in Ohio.

    They are being told to do pretty much the same. Also they are laying off nursing staff in their area as well.

      The Hospitals get $39,000 per Patient from the Federal Government for every patient that they place on Ventilators. It doesn't say how long they have to be on a Ventilator, they just have to be on a Ventilator for 5 minutes, and head to GO and collect your money. So it creates a Financial Incentive to put people on ventilators, and then take them off, and put someone else on a ventilator......more $$$$!!!!

      I too wish things were different. Sad thing is, the world seems to be going down the tubes and maybe it's better not to be born into or choose to live in the world they create. It's torture and torment every day to live next to those who make it their goal to Desecrate and ruin any sense of righteousness.         According to the data from this morning, of the seven laboratories sending us COVID-19 results, about 118,000 were tested and 54,600 came back positive. The positivity rate has gone up two percentage points to 46.22%. On Saturday evening, the Department of Health sent out guidance to all of our hospitals on the allocation of critical care resources during a public health emergency. The document provides guidance for the triage of critically ill patients in the event that a public health emergency creates demand for critical care resources that outstrips the supply. The model was adapted for New Jersey from University of Pittsburgh Department of Critical Care Medicine, their policy, and it was adopted after review and input from our multi-disciplinary Professional Advisory Committee.

        These triage recommendations will be enacted by a hospital only if:

        1. The hospital is operating under a crisis standard of care.
        2. Critical care capacity is or will be shortly overwhelmed, despite taking all appropriate steps to increase the surge capacity to care for critically ill patients.
        3. A regional authority or a state authority has declared a public health emergency.

        The guidance describes the creation of triage teams to ensure consistent decision-making. It includes criteria for initial allocation of critical care resources and reassessment criteria to determine whether the ongoing provision of critical care resources are justified for individual patients. The framework is designed to create meaningful access for all patients. All patients who are eligible for intensive care or critical care services during ordinary circumstances remain eligible, and there are no exclusion criteria based on age, disability, or other factors. The framework ensures that all patients receive individualized assessments by clinicians based on the best available objective medical evidence. It ensures that no one is denied care based on stereotypes, assessment of quality of life, or judgment about a person's worth based on the presence or absence of disabilities or other factors. And lastly, it ensures that discrimination based on race, creed, color, national origin, nationality, ancestry, marital status, domestic partnership or civil union status, sex, affectional or sexual orientation, gender identity or expression, disability, place of residence, socio-economic or insurance status, is explicitly avoided. And to the extent possible, those making allocation decisions should be unaware of these patient characteristics. The goal of the allocation framework is to achieve benefit for populations of patients often expressed as doing the greatest good for the greatest number.

        As you know, we have developed a regional approach to share resources and supplies across the north, central and southern parts of the state. Because of this approach, no institution should have to resort to limiting access to critical care resources, including ventilation, while neighboring or regional or state institutions still have capacity. Again, these triage guidelines are intended to be the last resort. We hope and have planned that they will not be needed."

    People mostly assume when reading something like this that it applies to the elderly - but it actually also affects anyone with a high-risk medical condition. Someone young & otherwise functional, under these laws, could be denied their life just because they require certain treatments in order to live. Who gets to decide who has the best chance of recovering & living? In many situations people who are high-risk can come close to death, but with the proper treatment you would assume they'd get, they would make it and be just fine in life. But according to this monstrous rule, the medical ghouls get to decide if anyone with any risk is worth saving at all. This is so wrong, on so many levels.

    Hey all. From the sounds of it most folks here prepare more than the average person BUT... if not. Now is a great time! Plant a garden, find fruit trees that do well in your area. We just cut down some oak trees in our small horse pen(no we don’t own any horses... came with the property...). we are going to plant orange, lemon and grapefruit trees. We also planted a small “learners garden”, just to figure out how to improve for next year. But now is a good time. If SHTF you will thank yourself for your efforts!
